By accessing or using Gabby, you acknowledge and agree to abide by the terms, conditions, rights, and responsibilities outlined in this Agreement. Its purpose is to foster a safe, fair, and enjoyable experience for all users. We strongly recommend reviewing this document thoroughly before using any of our services.
This User Agreement (the "Agreement") governs your use of Gabby's services (the "Services"), including the Gabby App and related platforms operated by DelightMatrix Technology Limited ("we," "us," or "Gabby"), with its registered address at FLAT/RM A 12/F ZJ 300 300 LOCKHART RD WAN CHAI HONG KONG. When using the Gabby Services, you are also subject to our Privacy Policy and any additional guidelines we make available.
By using our Services or completing registration, you agree to this Agreement. We may revise this Agreement from time to time; the current version will be available at the link provided in the app or website. Continued use of the Services constitutes acceptance of the revised Agreement.
You may only use our Service if you are 18 years or older and not prohibited by applicable law. You are solely responsible for maintaining the confidentiality of your account and password and for all activities under your account.
Gabby allows users to create, post, transmit, and store content (messages, text, images, etc.) through features such as Star Catch, chat, and profile. User content and conduct must comply with this Agreement and our community guidelines. We employ measures to detect misuse, harmful conduct, and situations where we can help protect our community; we may take action including removing content, restricting access, disabling accounts, or contacting law enforcement where appropriate.
To open an account, you will be asked to provide information such as an account name and password. You must provide true, accurate, current, and complete information. We reserve the right to disable your account at any time, including for breach of these terms or for conduct that we believe may damage the Services or violate third-party rights or applicable law. If you wish to delete your account, you may do so through the app (e.g., Settings > Account > Delete Account) or contact support for assistance.
Your privacy is important to us. Please see our Privacy Policy for how we collect, use, and disclose your personal information and how you can manage your privacy when using the Gabby Services.
Your use of the Gabby Services is subject to this Agreement and all applicable laws. You agree not to: (i) create, upload, or distribute content that is unlawful, infringing, defamatory, obscene, harassing, or otherwise objectionable; (ii) impersonate others or access others' accounts without permission; (iii) harass, abuse, or collect personal information about users without consent; (iv) circumvent security or access controls; (v) interfere with or disrupt the Services or other users' enjoyment; (vi) use the Services for any illegal purpose or in violation of any applicable law. We are not liable for user content or for any loss resulting from your use of the Services; use is at your own risk.
You retain responsibility for your user-generated content. By posting content on the Gabby Services, you grant Gabby a license to use, display, and distribute such content as necessary to operate and improve the Services. You must not post content that: promotes illegal conduct, discrimination, threats, harassment, child sexual abuse material (CSAM), violence, intellectual property infringement, misinformation, spam, or self-harm promotion. We may remove or restrict access to content that violates these terms and may suspend or terminate accounts. Please report any content you believe violates our policies using the reporting tools in the app. See our Child Safety Policy for reporting CSAM.
If we offer virtual items, subscriptions, or other paid features, additional terms and pricing will be disclosed at the point of purchase. Purchases may be final and non-refundable except as required by law. You must be 18 or the age of majority in your jurisdiction to make purchases.
We may terminate or suspend your access to the Gabby Services at any time, including for breach of this Agreement or for conduct we reasonably consider harmful. Your only remedy for dissatisfaction with the Services is to stop using them and, if you wish, to delete your account.
The Gabby Services are provided "as is." We do not guarantee that the Services will meet your requirements or be uninterrupted, timely, secure, or error-free. We are not responsible for third-party content or external links. We are not liable for force majeure or events beyond our control.
This Agreement shall be governed by the laws of the Hong Kong Special Administrative Region (or as otherwise stated for your region). Disputes may be resolved by arbitration or courts as specified in the full terms made available in the app.
We may amend this Agreement from time to time. We will use reasonable efforts to notify you of material changes (e.g., via the app or website). Your continued use after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Services.
This Agreement constitutes the entire agreement between you and Gabby regarding the Services. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
